Question
my son was summons to appear in court with records of property and things that he owns to satisfy a judgement against him. he is on social security disability and owns nothing except a 1999 car. can the courts take his car to satisfy this default financial judgement. the amount owed is about 6700 the value of the car is about 5000

Answer
It depends on your state and whether there are any state exemptions. Some states have exemptions on personal property that cannot be attached. Other states may allow for levy against property that may be sold at auction to satisfy a debt. If this happens he may need to file bankruptcy to avoid the levy. Let me know what state you are in and I will research it. He may be safe so tell him not to worry. However, if he received a subpoena it is mandatory he show up. He is in a hardship so it is not likely they will get anything.
