Question I was divorced in Aug. 2002. When I was divorced my wife was deemed responsible for the credit card accounts. We had a $10,000 bank card account. She paid most of it off however in Nov. 2003 she took out a $8,500 charge on the card and now is refusing to pay the bill. The credit card company is now coming after me to pay the bill. I am on social security tempory disibility and a small pension. Can I be held liable for this charge. The credit report shows me as being deliquent on this bill.
She said she had to keep the account open to pay the bill and the card is still in my name.
She had no permission from me to use the card.
Answer Hello Frank,
Thanks so much for choosing to write to me.
Dealing with spousal responsibilities PRIOR to the divorce is pretty cut and dry. Unless the creditor is a PARTY to the divorce, then both parties are liable to the credit card companies REGARDLESS of what the divorce papers say.
Now, your situation is different in that you have been granted the formal decree of divorce by the court in 2002.
Now, at the end of 2003, she goes out and uses YOUR card?
Here is the slam dunk solution.
1. Call and file a police report that your card was used without your approval.
2. Send a copy of that to the Credit Card company and DEMAND that they remove the item from your report.
3. If they do not remove the item, let me know and I will advise you how to move forward. Its an easy process.
4. Finally.. Call the credit card company TODAY and cancel the account and DOCUMENT who you talked to.
This should clear the matter up, the fraud department of the credit card company may want a copy of the divorce decree, go ahead and provide them with that. Do not give them anything else other than a copy of the police report.
