Question
I had some financial difficulity a little over a year ago and could not pay Chase Bank the $35k i owed them on a VISA card plus a few other cards totallying $55k. I am not paying any of these cards now. I then contracted with a debt reduction agency and after a year could not make the $950 payment that was schedule for the next two years. The debt management agency paid off one capitol one card and did disburse the remaining funds in the account they set up for me after i withdrew from their program (that was september).
TOday I was served with papers that Chase was suing me for $39k and I am to appear in court in February. I cannot afford a wage garnishment, my house(NV) is upside down (i owe more than its worth) and I currently live in another state (WA). I switched jobs so that i made more money so I could try to get my debts paid. I've paid off two other loans and the one credit card but, need more time to pay off the Chase card because its so much.
I cant' sell my house..that dosent help, i'm upside down by 80k. I have no other assets. I live close pay check to pay check right now because i'm paying off other debts. I could come up with another $200-300 to start a repayment plan but, that would take a long time for Chase to get their money..would they condiser this?
what are my options to deal with this?

I want to take a moment to thank you for writing to me on your Chase Bank Account Lawsuit.
I am seeing more and more of this as people all over the country are realizing that the American Dream has become the American Nightmare. The fact the your own home is upside down by eighty thousand dollars means that there is really no way for the creditor to get paid, as they are certainly going to foreclose.
So, you also mentioned that you are or were dealing with a debt reduction company. Ayoid these places like the plague. They do not end up helping you and just kill you in fees.
Today, on the papers that you received from Chase, you most likely were sued by one of the debt and potfolio buyers that bought your account. As I do not have a copy of the documents, I will assume that what you received was a summons and complaint.
It is VERY IMPORTANT to respond to the complaint as soon as possible. Do not miss any court deadlines and be sure to send copies of the reply to the court.
The bottom line is that a payment plan is the way they are going to get paid, if at all, so just call the attorney and do a workout on the balance and come to an agreement on what you can pay.
Then send documentation to the court proving the deal.
