Hi Robert,
 Back in late 2002, I went on a trip to South Carolina.  (I live in Missouri.)  Before I left, I called AT&T Wireless, who was my cellular provider at that time, to verify that I could use my cell phone while away and to check on any additional usage charges that might apply.  I was assured by their customer service rep that the area I was visiting was a covered area and that no roaming or long distance charges would be incurred.  I was gone for four days and used my phone to call home while I was away.  The next month, I received a $1272 cell phone bill.  I was outraged because not only had I been charged for roaming and long distance (after being told I wouldn't be) but I was also charged for calls placed after 9pm, during my "free" minutes.  I called the company and was told that the charges would be reversed.  I was then told, by another representative, that there was nothing they could do.  I refused to pay the bill at that point.  They called me a month later, asking for payment, which I refused again.  I never heard another peep out of them.  It just hangs out on my credit report, waiting to fall off.  A week ago, I got a phone call from a collection agency with an "attorney's name."  This guy informed me that the charge had increased to almost $1700 (from the original $1272) and that he would settle for $1300, check by phone.  I refused to pay and he told me that he'd "see me in court."  Last night, around 8pm, he called again.  My family and I were outside at the time, so when I got the message, I called back but was told the office was closed.  So, I returned his call today.  The phone call ended up in a screaming match between the two of us, ending with him hanging up on me.  He was quite obviously looking over my credit report (without my permission, I might add) while we spoke, because he rattled off things like, "I see you have a car payment.  That's right...keep building those assets because one way or the other, I WILL get my money."  He threatened to sue me again and I told him that I'm a full time student with no job and bid him good luck.  I have several questions about this issue.  First off, how do I defend myself against this bogus bill?  This jerk informed me that I "should have had the customer service rep put it in writing for me when he said I could call home while away."  I mean, who does that kind of thing?  When they told me that it was alright, I believed them.  Secondly, is it even a possibility that he could put a lien on my vehicle if he should take me to court and win?  I'm thinking that no judge would hand over a $10,000 vehicle in exchange for a $1200 cell phone bill but who knows?  And lastly, do I have any rights at all?  It's really begining to feel like I don't.  Thank you so much for your help.

Thank you for taking the time to write to me about the situation wih ATT Wireless.

After reading your story I am quite enraged at the whole ATT Wireless Customer Service Process.

The first thing that I need to know is WHO the collection agency is.  The next thing is that I need to see who is representing themselves as an attorney to collect from you.

Listen carefully to this bit of advice.  Go to WalMart and buy a DIGITAL Recorder.

Call this collector (unless he is with Allied Interstate, Unifund or LDG and then IMMEDIATELY CALL ME) and record the call.

I also want you to goto our website at www.mycollector.com and spenddome time there listening to the calls that are recorded.  This is essential.

The big issue is that he said "I will see you in Court" and trust me, after you listen to the conversations between my office and these collection companies, you will see clearly what you can do to turn this around.

DO NOT PAY ONE DIME ON THIS ACCOUNT.
