I had purchased a $23,000.00 2001 GMC Yukon with my ex-fiancee in April of 2003. I was making $10.00 an hour and my fiancee was making $375 a week on unemployment. I had immaculate credit, 748 midscore at the time. Not bad for being 25 with no mortgage history. At any rate we were approved with 2k down, how I am not sure looking back.
I made on time payments for about one year in the amount of $500 every month. Me and my ex split up and she got the car which was only in my name because she had no credit. She claimed she could afford it because I knew I could not. Payments were late and behind off and on for about 1.5 years. The car was finally repossed in June 2005.
I paid about $1,200 back in collections to this point only to have them say that they will not accept a payment plan any longer. Thus I have not paid on the collection since May 2006. I am of the understanding that the SOL is 6 years. I am trying to buy a house in a year and this account has me very worried. My credit otherwise has been superior. I have never been late a day on anything besides this truck that I should have never purchased.
What are the actual chances of them taking me to court of $7500? Is there any recourse for them overstating my income for loan approval as I believe they have done (there is no way I should have been approved.)? Also is the SOL really 6 years? So after 6 years it will no longer show up my my credit report? I would like to have this debt paid off but I need to weigh my options as my income and debts are tight right now.

Looking at your issue, I want to say that it is not uncommon for Credit Grantors to simply base their credit decision on what is known as an automated mattrix. In other words if you have a warm body and a 700 credit score, you are approved. (FYI.. To my readers.. the closer to the end of the month you get the lower the criteria)
So, now lets look at the real issue. You want to purchase a new home in about a year. This is dooable, so long as we work together to ensure that the ENTIRE TRADELINE is DELETED upon payment in full or settlement.
I understand that she had the car, and what is really crazy is that she will have no adverse consequences of her actions, as it all falls onto you.
