i was in the hospital for ER service on a sunday 11/27/05, my insurence covered all the expensive charges, around $600.
however, an extra bill came, from the doctor's union i assume, asking me for $27 more for a "sunday / holiday" charge. this was not from the hospital.(and my insurence company declined to pay , citing this charge should already be included in all the other ER bills)
now, i do not remeber seeing any sign or signing any docs for this charge. even if i did, i do not believe i was lucid enough.(i was in the ER with a swolloen forehead due to shingles afterall)
now this $27 has gone to collection. i've already written them that i will dispute the charges, my questions:
1. why cna't they bundle this with the ER bill, why the extra afterward charge?
2. am i liable?
3. if i don't want to wait around, what are some of the pre-emptive things i can do? such as dispute the charges in small claim court?

This may be legit or it may just be what the collection agency thinks is a clever way to get that last extra dollar out of you - or the doctor himself or his business manager just added it on - who knows?
2. am i liable? For the 27 dollars - again, what difference does it make? This is a small thing that the creditor and the credit bureaus are obviously trying to make a big deal.

You can sue them, but they are the ones that would sue you, not vice versa, and then you could assert your defense. Even if it is invalid, is it worth this much trouble (bringing a lawsuit)?
It seems you only have two sensible choices.
Pay athe 27 and be done with it - if you do so the negative on your credit report would not hurt you all that much either way, whether you paid or not.
Don't pay and send in a written statement to each of the credit bureasus explaioning in a very short summary that you are not liable for that debt. You have a right to put a short statement of whatefer you want on there regarding what you say is an incorrect entry.
