Question My question is: I recently pulled a copy of all 3 credit reports. I have an error on Equifax that lists a collection agency. I contacted Equifax, they can not provide me any information on the company. I have disputed this date with them twice-I get the standard "verified" answer within 5 days of the dispute. I finally tracked down a phone number to the company. When I phoned them I was told I had written a bad check to a payday loan company 4 years ago. This company has never contacted me for this debt-this is not mine. I have a fraud alert on my credit report because my vital information was stolen. I have asked this company to verify this debt or remove this from my report. I do not have any outstanding or bad checks to anyone. I have never had a problem writing a check or opening a bank account. This company still has not provided any information or verification for this. What should I do now, and how long do I have to wait for this to be resolved? Thank you.
Answer If you have done everything that you are supposed to do insofar as requesting that the debt be validated and they have, in effect, refused to do so, your next move would be to ask the courts to not only order them to correct the incorrect entry but also have them pay your any damages that you have incurred as a result of their failure to follow the federal law.
