Question

can a div 1A football player transfer to a division 1AA, and be eligible to play, after he has requested and was refused a release from the current school?

Don, hello!

I've attached the NCAA Eligibility websites.  Your question is more legal than what the rule book states so review the rules and then call the NCAA for an official opinion.  Their phone number is attached.  

Logic tells me you can be released from your scholarship unless you are indebted to the college that would not give you a release.  You would not have to sit out for one year if you were transferring to a lower division, and if your grades meet the NCAA minimum standards.
