Question
Hi Jim-

I have a business in a commercial shopping center.  There are about 9 different types of businesses in the shopping center.  This year my CAM charges were increased from $350.00 to $825.00.  I spoke to other tenants who stated their CAMS were capped at 3% per their lease.  As for me, my lease is silent about a cap on CAMS.  In other words, the languge is completely open-ended.  Am I a total fool for failing to negotiate my CAMS?  What can I do?

If everyone else in the shopping center managed to negotiate a annual cap on their CAM costs, you appear to have missed an opportunity.  Always ask for a cap, or at least a cap on certain expenses.

You could talk with your landlord and ask for a cap, or try to shame him into giving you a cap like the other tenants on your CAM charges now, but I would be surprised if it would be a successful effort.

Do remember that you want a cap if the landlord ever needs you to assist him with a problem he has encountered.

I have had a business for the last 14 years advising virtually every form of business entity from large national corporations to the smallest ma & pa new businesses regarding a wide range of commercial real estate matters in addition to property management and commercial leasing.
