Question Hi Brian
I have a question regarding the purchase of a house 5years ago. My father, who was unaware of the legal procedures.. purchased a new home in 2004. It was being built, and the closing date was not for another year. The real estate agent and mortgage consultant at that time were family friends. They had a bit of a fallout with my father, and unknown to my father, sold the house to another purchaser without my father's signature. To this date, we are unaware of how this took place.
Is there anyway of proving this? Or taking legal action? Is there anyway of attaining the paper work associated with the new buyer?
It has been awhile since this took place, yet my father never attempted to understand what took place.
I would really appreicate your input on this matter before taking this a step further.

5 years is a long time. I am not sure what can be done at this point. I would assume your father had a contract on the property and had put a deposit down. Your father's attorney should have all the paperwork. They (your dad and his attorney) should have been notified that the contract has been terminated and depending on what was written in the purchase agreement would determine if the seller had the right to terminate and if so what your father was entitled to.
Your best bet at this time is to review the contract it should all be spelled out in the document.
