Question
I live in the state of Massachusetts and I am going through a divorce.  Six months after we separated, my spouse hired a private detective and hacked into my private yahoo e-mail account and discovered I was seeing someone.  I know this is a fact because her attorney informed me during a deposition.  My wife is threatening to post the e-mails "all over town."  Is this legal and do I have an recourse?

Hi Dan,

Well for someone who is supposed to be an attorney that person was pretty stupid. They admitted to being a part of a crime?, and on record?

Mass law, Chapter 266: Section 120F. Unauthorized access to computer system is one law they broke.

ALso Chapter 266: Section 37E. Use of personal identification of another; identity fraud; by using your user name and password.

I would get a copy of the deposition and contact the local police. Show them where they admit to breaking into your e-mail account and that should be about it. Its a crime to break into someones computer e-mail.

I conduct computer crime investigations in conjunction with the F.B.I., Alachua County Sheriff’s Office, Gainesville Police Department, and University of Florida Police Department, Levi County Sheriff’s Office, Starke Police Department and other agencies in the North Florida Court District. I provide the forensic data recovery services for those agencies as well as internet tracing and information gathering. I am a Federal Court Certified Expert in Computer Crime Investigations and Forensics. I teach Computer Forensics for the University of North Florida, Institute of Police Technology and Management.
