Computer Law/Employer logged into my personal email

Question
While I wasn't at work my employer had the company's IT guy go through my computer to see what I've been doing. I suppose he was suspicious of me sending information through my email, leads and such to myself. He succesfully got into my PERSONAL email and read my emails. According to Florida Statute 815.06 that's a third degree felony; however, if I did send some information through my personal email that would prove his case does that make me guilty of a crime or him?!

Hi Sarah,

FSS 815.06 as you say has to do with unauthorized access to computer systems (including e-mail accounts.) You employer and the IT guy are the ones that are in trouble. You need to file a police report to document the incident.

If you "stole" company information and sent it out through your personal e-mail, you may have issues with that also.

I need more information as to what happened and in what order so I can make a better call on what really happened and the real chances of anything being done about it.

I conduct computer crime investigations in conjunction with the F.B.I., Alachua County Sheriff’s Office, Gainesville Police Department, and University of Florida Police Department, Levi County Sheriff’s Office, Starke Police Department and other agencies in the North Florida Court District. I provide the forensic data recovery services for those agencies as well as internet tracing and information gathering. I am a Federal Court Certified Expert in Computer Crime Investigations and Forensics. I teach Computer Forensics for the University of North Florida, Institute of Police Technology and Management. I also teach Computer Crime courses for Tallahassee Community College, Pat Thomas Law Enforcement Training Center. Associate Instructor; teach Computer Crime courses thorough out the world for IPTM.
