Hello cammander ~

My husband and I recently experienced we wish we had not. My younger daighter and her boyfriend, who live in Florida, ( we live in Ga.), Had sent me an email, which looked like something they were replying to something I had wrote, do you get that? Anyway, this email consisted of a "solicitation" of sex to get her up here away from her father. They had then went to the local PD there and filed a report on this, we did the same here. My daughter then had admitted to her father that they had fabricated the whole thing. Her boyfriend and her are now being delt with by local athorities. My ex-husband started speading the rumor that my husband now has an 8 page arrest record, and said that the local PD in his area told him this. We recemtly found out by call there local PD that they did not say anything like this nor did they show him my husbands arrest record. Our questions are this:
 A) can we also press charges on my daughter for the anguish she put us through? She does not even realize what could have happened!
 B) could we press charges on my ex-husband for defamation.  
 c) What all can they be charged with?

Hi Tim and Marie,

I am sorry you are having all these problems.

Well as much as you would like to, you can not press charges for causing you anguish. You could try and sue her, but I don't think your chances are very good.

As for your ex, you can only sue someone for defamation of character when what they say or write has resulted in you losing money because of it. Such as someone does not hire you because they say they saw a letter you ex wrote about your current husband. Plus the allegations must be untrue. So unless there is monetary loss, you really do not stand much of a chance there either.

They (your daughter and her boyfriend) are already being charged criminally, as for civil actions, that is not really my specialty, but I don't think there is much you can add to what they are already going through. The police will charge them with everything they think is appropriate, trust me.

Best thing is to ignore your ex's rumors (remember he is your ex.) and move on. People that I know do not pay to much attention to stories being told by ex's about their former spouses new spouse.

I conduct computer crime investigations in conjunction with the F.B.I., Alachua County Sheriff’s Office, Gainesville Police Department, and University of Florida Police Department, Levi County Sheriff’s Office, Starke Police Department and other agencies in the North Florida Court District.
