Question
Is it legal to access porn sites that have erotic literature (stories, but not photos) of illegal topics that would not be legal if it were a film.  For example, pornographic lit sites that have snuff, underage, rape, etc. fiction.  If it is illegal in the US (wondering about California), what are the penalties and what law does this fall under?  Have there been any cases tried and has anyone been convicted?

I also have a separate question of what would happen to someone if they accessed a site like that and found out, after they accessed it, that the server had a directory that did have photos, but the person never clicked on that directory.

Hi Kerny,

There is no law against writing anything (other than death threats to a real person) that I know of. I have encountered these writings in some of my investigations and they are generally found on child predator and child pornographers computers. They are very disturbing most of the time.

As for the directory, no access is no access you can't be charged with something you did not do.

I conduct computer crime investigations in conjunction with the F.B.I., Alachua County Sheriff’s Office, Gainesville Police Department, and University of Florida Police Department, Levi County Sheriff’s Office, Starke Police Department and other agencies in the North Florida Court District.
