I am a police Commander that conducts Computer Crime Investigations at the Local, State and Federal level. I have investigated all most any kind of crime with which or which involved a computer and the internet, from murders, kidnappings, extortion, drug dealing and more. I have worked in both Facebook and MySPace, also in Peer to Peer investigations. In addition I can answer questions concerning child predators and how to make your children safer on-line.
I teach Computer Forensics, Internet Investigations, Peer to Peer Investigations and other computer crime related subjects for several colleges and the Institute of Police Technology and Management.

Question My daughter became involved with a person on myspace that was not the person she thought he was. It ended up that this person was a girl not a guy. She had communications with this girl she looked at as if she was her boyfriend although they never met for 2 1/2 yrs. Communications were by cellphone, AIM and telephone. She did talk to a boy and so did I. The problem- This was abusive verbally and controlling she broke it off. He threatened to kill himself and supposedly did. This person that she initially talked to for this time turned out to be a girl and a boy that go to her school.A 1/2 naked picture was hung in her school on her locker of herself. Then this fake person she thought was a boy killed himself. There was a funeral planned. I called the funeral home no such person was scheduled. This person was fake. The phone numbers of the cell phone belong to the girl. There was communication saying she hsould be dead. These people get on her AIM account and pretend they are here. There was a conversation this person had that we have saved adnitting to hanging the picture. The city police are involved as the school is in the city limits. The state is involved as we live in a different county and that is where she has recieved the harassment. This happened 6 weeks ago and the police state and city have yet to take our full statement and harassment keeps going on. How do we get help and the attention this deserves? What laws have been broken. The girl is under 18 the guy is 19 and is going into elementary education and helped out at the YMCA teaching kids how to use the computer. My daughter is trying to be strong but believes that some day these people will hurt her, all though they went to her same school and never directly spoke to her. HELP what laws have been broken?

Sorry it took a couple of days, I had to really research this one. PA law is pretty clear once you find it though. Its Harassment at the least. Possibly stalking under PA statues. You need to report this to the police as soon as possible as electronic evidence is involved and the more time that passes, the more evidence can be lost.
If your local police can't help you, your state police have a Computer Crime Unit. Pennsylvania State Police Computer Crime Unit 610-344-4471 .

§ 2709. Harassment
#a# Offense defined.--A person commits the crime of harassment when, with intent to harass, annoy or alarm another, the person:
#1# strikes, shoves, kicks or otherwise subjects the other person to physical contact, or attempts or threatens to do the same;
#2# follows the other person in or about a public place or places;
#3# engages in a course of conduct or repeatedly commits acts which serve no legitimate purpose;
#4# communicates to or about such other person any lewd, lascivious, threatening or obscene words, language, drawings or caricatures;
#5# communicates repeatedly in an anonymous manner;
#6# communicates repeatedly at extremely inconvenient hours; or
#7# communicates repeatedly in a manner other than specified in paragraphs #4#, #5# and #6#.

#b.1# Venue.--
#1# An offense committed under this section may be deemed to have been committed at either the place at which the communication or communications were made or at the place where the communication or communications were received.

"Course of conduct." A pattern of actions composed of more than one act over a period of time, however short, evidencing a continuity of conduct. (a) Offense defined.--A person commits the crime of stalking when the person either:
(1) engages in a course of conduct or repeatedly commits acts toward another person, including following the person without proper authority, under circumstances which demonstrate either an intent to place such other person in reasonable fear of bodily injury or to cause substantial emotional distress to such other person; or
(2) engages in a course of conduct or repeatedly communicates to another person under circumstances which demonstrate or communicate either an intent to place such other person in reasonable fear of bodily injury or to cause substantial emotional distress to such other person.
