Conservatives - Government ability eavesdrop

Expert: Paul Edward Zukowski - 4/1/2006

Question
Phone calls should be private. Should the government have the right to listen in on private citizens' phone calls? According to your ethical position, should this be allowed?

Answer
Hi,
Sorry for the slow responce, All Experts had tech issues of the weekend that prevented a responce.

Its really not a matter of ethics but of laws.

It depends on the exact situation.
You made a blanket state. But things are not that clear.

Cell calls can be heard with a police scanner in many case even if your not trying. Its quasi-broadcast.  Those have a bit less protection. If the government purposefully listens in a warrent is required.

Calls from hard wired phones inside the United
State are protected and warrent is needed to listen in.

Calls coming from outside the USA or going to outside the United States can be monitored for intelligence purposes. The party outside the USA is not protected.
A warrent is not required if time is of the essence. It must be reported the FISA Court and Congress promptly. This is limited to intelligence purposes. A warrent would be needed if your going continue to listen in for a criminal complaint.

The British Intell monitors the USA through Project Echelon. The USA monitors the rest of the world
including Britian. Its and NSA/MI5 project.
Its not a secret, Project Echelon was reported on on 60 minutes 15 to 20 years ago. If you say certain key words
like bomb the super computer flags the call and someone listens to the call. If if the Brits find anything of note its turned over to our intell. We do the same in monitoring the UK.

Defending the nation is the primary job of the executive
branch.

If you asking about the recent NSA program the FISA
court determined it a warrent was not needed
if one side of the call was in another nation.

There been a lot of politics being played on the issue
lately. Infact Jimmy Carter had authorized the same thing while in office.
as did Reagan and Clinton.
If you read closely nobody is saying it should stop.
