Question I am an independent consultant. Details were issued by e-mail on behalf of my client to 3 No firms to provide a quote for undertaking a topographical site survey.
Client elected to take the cheapest quote.
A firm who submitted a quote have demanded to know the details of the firm who were appointed including their price.
Am I liable in any way if I do not give this info to the unsucessful firms and is this quotation process classed as competitive tendering ?
Answer I am sorry I did not receive the question, it must have been caught in my spam filter. It sounds like a legal question to me, something that your lawyer should advise you on instead of a contractor. As a practical matter I try to provide results as transparently as possible to vendors, without giving away sensitive information (I may indicate in a general way what the competitors price was). You may not get responses from the firm in the future if you do not provide some feedback. I also try to indicate in the solicitation that the selection is completely at the discretion of the client, so that they understand the rules going in.
Was the scope of the work clearly defined and were the bids relatively close? If not, your client may have issues in the end choosing the low price.
