Question
I am a general contractor. I hired a contractor to build a screen room for one of my clients.  He filed a notice of commencment and pulled his own permit.  the home owner payed me and i in-turn payed the sub con. I gave them a receipt and the sub con. gave me a receipt upon payment.  The home owner also has a contractors final payment affidavit from the sub con.  
 The sub con. has went out of business and failed to pay his supplier. the supplier is filed a notice to owner to the home owner and to the sub con. Is the home owner at any risk of having a lien put against or is the sub con. going to be responsible.

Do you or the owner have a notraized sworn statement from the sub. listing his suppliers and that he paid them?  If you do he has committed a crime.  If you don't, you only paid him and the supplier can file a lien on the property.  The home owner may have to pay again and go after the sub and you.
