Question Not under a FIDIC contract but general. The prelims on this project were evaluated in a boq as being paid monthly. There is a clause within the contract allowing the Engineer to pay Pelims on a percentage of work done basis. Previous payments have been made monthly, now due to a delay the Engineer wants to pay as a percentage of works done. Help!!!!
Answer Hi Michael,
I would assume the preliminaries are anyway representing a total of the executed works, which you indicate yourself. In which case I believe Engineer is right.
As much as you work, is as much as you get paid, prelims included, thus I don't see a problem.
