Construction Law/Advance payment


Is there any rules to pay advance payment to contractor wheather AP will be paid only to work contract or even for maintanance project we are using fiddic 99 silver book

Good Day Shoaib,

Advance payment in FIDIC 1999 is govern by terms and conditions in accordance with SubClause 14.2. If the Employer fails to issue an Advance payment within the time stated in Subclause 14.7 (42 days) then pursuant to subclause 14.8, the Contractor can seek  compensation for delayed payment.Once the contract is governed under FIDIC 1999 (maintenance or construction contract) these specific guidelines should be followed.
