Construction Law/Effects of removing Prelims from the BoQ


Dear Sir,
We are Engineering Consultants in the UAE.
A Project is in a Pre-Tender stage.
The Client does not want to pay the Contractor's Prelims and wants the section to be completely removed from the BoQ.
The Contractor will obviously value them and distribute these within the measured items.

The question is :
What will be the problem areas and the disadvantages to a Client under different scenarios:
e.g. Extension of Time, Large Increase / Decrease of some quantities, etc.

Your answers will help me formulate a list and try to dissuade the client from this particular idea.

I can only confirm what I see you already noticed.

Most likely, Employer will pay more.

There is nothing free in this world, it is only a question if you want to pay fair, in an open and transparent way, or you want to pay probably more, but have your ego satisfied and lie yourself that you got something free.

In the end, if Employer can not be defended from themselves, so be it!
