Construction Law/Notice to Claim


If a contractor writes a sentence in a letter addressed to the Employer that "as your instruction is extra contractual, we reserve our rights to claim the additional quantity becasuse of your instruction: Shall this sentence be treated as a notice to claim under clause 20.1? My contract is EPC/Turnkey Contract FIDIC 1999. e.g in contract concrete grade is C15 but the Employer instruct concrete grade C18. Can above statement be treated as a notice under 20.1.

It depends very much on the context, but it definitely worth a try.
Especially if the Contractor has indicated Sub-Clause 20.1.
Again, depending on the context, there are high chances for that notice to be upheld in a dispute adjudication.
