Construction Law/Delay Penalty or LD

Question
Greetings

In our General Condition of Contract for recovery of delay damages using the word "Delay Penalty" instead of Liquidated Damages. Please comment.

Answer
Dear Shoaib,

This terminology as Delay Penalty and Liquidated Damages are both used in different forms of contract. The main concept is either to compensate the Employer from his losses due to delay as LD or to apply penalty to the Contractor for his delays. FIDIC uses the term of LD.
