Construction Law/Error in the Description

Dear Sir

FIDIC 1999

Assume that the drawing shows to install 150L water heater.Due to an error in the BOQ, it is described as 100L. Then the contractor has to use 150L or 100L water heater rate for the heater.

Could you give your answer for both re-measurable & lump-sum type of contracts.

dear Sudantha,
Thanks for the question
My response is as follows
depending on the priority of document clause, normally a new rate is required to be agreed
The work has to be done as per drawing within the quoted rate

I can answer questions based on FIDIC 4 and FIDIC 1999 [design-build] with particular reference to time extension , price adjustment and disputes. I am in particular more inclined for response to points pertaining to how claims should be framed and put up in case of technical or other contractual shortcomings. Regarding procurement matters I have spent over 5 years as procurement specialist for highway authority and dealt with numerous claims and disputes in the capacity of "The Engineer" .
