Question I recently signed a construction agreement to build my first house ever. The builders' wife was my realestate agent (dual agent) and she did not mention anything regarding contingencies to the contract. The builder then made mistakes on the foundation and in the eyes of the inspector fixed the mistakes, even though it is a big, cut up mess. I told them that I was not going to purchase the house, given that I did not feel that the concrete was to my satisfaction and that it did not match the blueprints that I had signed off on. They are now suing me for $100k and whatever other damages the court deems justifiable. I am 25 years old and have talked to half a dozen attorneys, half of whom think that I have a case and the other half saying that I should settle to get out of the contract. How is it possible for the builder who prides himself on "quality for life" sue me because he screwed up and I do not like the quick fix? I am so confused, but I am running out of time to answer, do you have any suggestions or other avenues to explore? Please help.
Answer First, immediately turn the lawsuit over to your homeowners or renters insurance agent and ask the insurance company to defend you. That might, but likely will not work. Second, hire an attorney if that does not work. You need good representation and cannot handle this on your own. Much depends on the contract and your attorney should consider filing a cross-complaint against the wife / agent and the builder. That cross-complaint will then be turned over to one or more insurance companies to defend them, bring some potential settlement money into the picture and get you some relief.
