Question We began construction on a pool and spa combo in palmdale ca. May 04 we had a 90 day contract, due for completion Aug 24 04. we still have no plaster, and the contractor will not answer our calls or give us a completion date. have contacted the BBB and they won't respond to them either. what do we do now? it's going on 180 days?
Answer Ms. McCormick,
Send a Registered letter to the contractor, advising them that they have "materially breached the construction contract, that you will be selecting another company to complete the construction, and that you will look to the defaulting company for reimbursement of any appropriate expense." Then, find a reputable company to complete the job. If the difference in cost is less than $5000, sue them in Small Claims. If more than $5000, see an attorney to sue them.
