My neighbor has been digging on our property and is killing one of our trees on a hill. My question is are we reasponsible for the damage she does to the tree, via killing it, or it falling on her property or car, house ect. If the tree dies do we have to pay to have it cut down or is she resonsible because she is the one doing the damage to our tree.

If the neighbor comes on YOUR property and kills or damages YOUR trees, it is your neighbor's responsibility to take care of the damage/cleanup and/or to pay you for your damages. Why did you let the neighbor on your property to dig, in the first place?
To answer your question, we did not let her dig on our property, she said she was going to do what she wants, the property lines are very strange in our neighborhood, we own some of her driveway, that is what she is mad at. We called the police 2 times on her and both times they said there isn't anything they can do about it, but to sew her and we don't have the money to do that, I have pictures of them digging and the damage she has done to the property. Answer Jeff, you should be able to find some attorney to take your case on the theories of trespass and damage to your property. Check with the local bar for referrals and then try the Yellow Pages if that does not work. You should know where your property lines are generally located. Make sure that you take more photos.
