Construction Law - responsibility for destroyed property during the construction
Expert: Barry Clifford Snyder - 8/13/2004
Question I hired a contractor to perform landscape work. I pointed him to a property line. For some reason the contractor destroyed trees on the neighbor's property. The neighbor demands that I pay for damages. Who is responsible: me or contractor?
Answer The contractor is primarily responsible and your are secondarily responsible. Look to your contractor and his insurance company to take care of the problem. Make sure that he does no ignore the responsibility. If he is not responsive, see an attorney immediately. You may need to put your homeowner's insurance company on notice if the contractor's insurance company does not take responsibility.
