Question
   Can I legally sell a music cd that I made completely by myself lyrics and beats are all my originals. Or would I half to start a business with a patented name and all so that I could tax them.

Jeremy, If everything is your (your original work) -- then go right ahead.  You do not need anything else.  My advice to you is to register the copyright on the lyrics and the songs --- www.uscopyright.gov or something close to that.  Make sure it is .gov so you know you are at the correct site.  They walk you through it and if costs something like $35.00.  Also form an LLC in you state.  Go to the secretary of state's website for you site and get to the form for an LLC.  Form it, file and then file for an EIN number.  Usually you can get that through your state secretary of state site as well.  An LLC will protect you form personal liability for anything and any money you earn through it goes right through to you without any additional taxes.  It is the same (for tax purposes) as if you were acting as a sole proprietor.

Patents are for inventions though.
