Hi George,

Can you please explain to me how the new nine month challenge period works?

Answer
It is a key provision addng one more hurdle for small businesses and independent inventors. It means that after a patent is allowed, anyone can challenge it. It is one of the reasons inventor activists fought the Patent "Deform" legislation. It was a sellout to the big corporations.

I, along with other inventor rights activists tried to inform our elected representatives and were totally sloughed off (i.e. dismissed out of hand...ignored). We are upset about it, both life long Republicans and Democrats alike.

Vote out, all that supported this, and other corruptions of our once inventor friendly patent system.

As a concrete example, I have a client who has come up with a game changing invention in the field of pollution control which improves combustion efficiency. In the case of vehicles, this is achieved without capital expenditures on the part of the general public. You can see it on www.YouTube.com (Search for "John Mullinix and Emissions")

Adding one liquid ounce (i.e. a shot glass for the Jersey boys!) of diesel fuel per ten gallons of gasoline kills the NOx and the CO harmful emissions and results, in most cases in a 30% improvement in miles per gallon. (Nissan engines don't get the mileage improvement due to a moisture control in their engine set up, but the pollution control aspects work.)

On You Tube, Mr. Mullinix gives individuals, on their personal vehicles, permission to use it. This does not apply to commercial fleets, refineries, manufacturers, etc. They will need a license. I have his permission to spread the word on this. His goal is to clean up the environment.  He also has the solution for diesel engines and external combustion engines (i.e. power plants and boilers, etc.).

At least one car maker just announced their research, where they are using direct injection to do the same thing, but in a much more complicated manner. As the invention date was back in 2009, and all the paperwork for patenting completed and filed shortly after, he is in an excellent position. We have a PCT filed preserving the rights for foreign national filings late next year. However, the post grant challenge provision makes it easier for the big corporations to complicate matters.

If your representatives approved of this...vote the rascals out!

I an the lead practitioner oner on this, but as Morgan and Associates, there are four practitioners on the team. Two on the patent application preparation phase, one an internationally recognized guru on the international patenting of automotive technology, and one a contingency lawyer. We are armed for bear on this one!

Mr. Mullinix is a retired rocket fuels bench scientist/engineer with additional heavy experience in automotive and aircraft fuels and explosives.
