Question We have been paying our mortgage on-time since not re-affirming it under our BK7, and the out-of-state lender (Countrywide) has been reporting them to the credit bureaus. I explained to my attorney that we want to sell our house next yr. and may possibly miss a few payments after buying a new house, and she said Countrywide would have the right to report late payments because it is a secured debt. My other creditor with a secured debt did not, and it seems that part of the BK protection is that discharged debts reporting late cannot affect a person's credit score SEPARATELY from the BK, that would seem illegal. Please confirm.
Thank you
Answer Starlett,
That information is wrong. The bank will continue to report to the credit bureau.
My suggestion, keep your current house. With a bankruptcy on your credit report no lender will loan during this current credit market.
