Question My wife and I just received our discharge papers after filing Ch 7 bankruptcy. During the process the 1st and 2nd mortgage companies (who were listed for us to not have to pay) asked if the "stay" could be lifted on the property so they could seek foreclosure. My attorney assured me this was a common practice when the property is worth less than what is owed so that the mortgage companies can seek to liquidate the property themselves instead of letting the courts do it. All seemed well until I received a summons in the mail from the 2nd mortgage company who is suing us for the amount we owed them. The debt was supposed to be discharged as stated on our paperwork. How is it possible that they are now suing us? and what is the likely outcome?
