Question
About 6 months ago I contacted my credit card companies to work out a payment plan on my debt.  Now, six months later, I am going to have to file for bankruptcy because my husband and I can no longer make the payments.  Two of the credit card companies still have an automatic withdrawal for payment coming out of my checking account.  Do I need to contact them and have them stop automatic withdrawing from my account or will they have to stop once I file for bankruptcy (I haven't filed yet)?  My husband thinks they can continue to withdrawal even after I file, until the case is settled.  I am just not sure how all this works.

Dear Heather,

Thank you for your question.

Contact your creditors and inform them of your intentions.  Be prepared to provide them with your attorney's information, and request a cease on the automatic payments.

Once the bankruptcy is filed your under the courts protection (known as an automatic stay) the creditors receive nothing until the outcome of the bankruptcy.
