Question
My exhusband and I bought a vehicle together.  We then got divorced and my exhusband kept the vehicle.  In our divorce papers, it stated that he was to remove my name from the lein.  He never did that.  He has recently died and the vehicle came back to me.  Is there anyway to return the vehicle or get out of having to repay the loan without it hurting my credit?

Hi Kasey,

This is an interesting question.  You'll probably want to take it to an attorney.  My specialty as my profile indicates is credit repair.

With that being said, my guess is that the only chance is to file a lawsuit against his estate to pay off the vehicle and remove your name.  Before I did that I would talk to the executor and see if there is an estate to speak of.

The lender has the right to collect from any party on the debt and the divorce decree won't matter to them.

There is always selling it if you have a buyer.
