Question
chapter 7. It has been in limbo for awhile. My attorney is no longer representing me. I want to dismiss. I wrote a letter to the court and they want certificate of service including name and address of parties served and date of service required. also,...to file with the court a certificate of service of the motion to dismiss on all creditors and parties in interest. I don't understand what i am suppose to do.Help

Dear John,

Thank you for your question.

Request from your attorney all information about your case. Search for information the attorney sent your creditors.  Once you find the documents create a form such as the one below.


The certificate of service needs to be included with the pleading you are filing and must be signed by you.   The certificate of service must state the following:

     • The date and the method of service

     • The names and addresses of the persons served

           • If a person being served is anyone other than a party to the case. For example if you send a pleading to an attorney for a creditor, you will need to include the name of the creditor.

CERTIFICATE OF SERVICE

     I hereby certify that a copy of _________________(document being served) was mailed first class, postage paid , this ____ day of ______, 2005 to:
