Question QUESTION: My husband and I filed Chap 13 BK in Nov 2004. It was dismissed in Sept 2006. We never refiled because we were able to manage our bills by that point. We figured everyone would come calling for their money but the credit card companies never did. Until this April when we received a collection letter. So, does the SOL include the time the debt was in BK? If so, AZ SOL is three years, has it legally expired? If not, would it be Sept 2009?

QUESTION: Thank you for the ARS cite, however, I thought credit card debt was considered an open ended or oral debt, not a written contractual debt. When would I have signed a contract with a credit card company? When I applied for and received the card? Just need clarification. Thank you.

Credit card debts are written contracts. Remember signing the receipt when you purchased an item from a merchant. Each time the written contract was affirmed.
The SOL begins after the last payment the credit card company received.
