Question
My husband purchased a truck before we purchased our home. The year we moved into our home, we let the truck go back (it was repossessed).Now 6 or 7 years have passed. And the economy the way it is, my husband lost his job in Sept. 2008. He went without finding a job for 7 months. He has finally, by the grace of God, landed a job 1 week ago today. Now we got behind on all of our bills ( Mortgage etc...) We found out today through our bank while trying to make arrangements with the past due mortgage payments (the bank gave us 3 months of debt relief due to hardship , but 2 weeks before this, we were served with foreclosure ( the beginning process of foreclosure) papers. Then they gave us 3 months of debt relief etc... We have been told by the bank that this ford fairlane credit put a lein on our house. Can they due this without us knowing about it ,even though the truck was repoed 6 or 7 years ago? And can they take anything else that is in my husbands name or mine, even though my name was not on the truck loan and what actions ( if any) can we take ?

Answer
First with regard to the foreclosure it is not too late to fix the problem. 99% of mortgage companies have workout programs that will give you a fresh start. I can help with this if you need help. Call 937 372 8581.

With regard to the lien, in most states they may only place a lien on your home if they have a judgment through the courts. They would have had to notify you of the proceedings and give you a chance to defend yourself. They may be lying so don't trust what they say until you can verify it.

You may be able to check the courts on line whether there was a suit filed against you. You can go to Google or Yahoo and type in your county clerk of courts and look for your local municipal court. Type in your name and search the court database for any suits against you. Or you may call the courts and see if they will confirm whether any suits were filed by the creditor. This will tell you whether they may have a proper lien against your home.
