Question
I currently have about $45k in debt. A family member had cosigned on a secured loan for me and there is about $7k remaining.  I want to file Chapter 7 BK but am afraid that this will negatively effect their credit. Can I remove my name from the loan and pay back my family member directly for the loan without effecting their credit and then file for Chapter 7?

Dear Zac,

Thank you for your question.

The chapter 7 filing will affect your family member.  Try to get your family member to refinance the loan only in their name.  When completed the current loan will reflect paid in full on both credit profiles. Your name will be removed from the loan and you can pay back you family member directly without effecting their credit.
