Creditors and Bankruptcy - Medical Debt

Expert: David - 6/11/2009

Question
Im 7 months pregnant and have medical debt that i obtained while in college. I was under my parents insurance and a full time student and had to have surgery. For some reason the insurance company did not cover it. My parents told me since I was in school they would pay it off. Well needless to say they never did and never gave me the bills. I found out that i owed 1300 dollars when they called my present employer. They would not negotiate a payment plan. Now they are serving me with court papers. I dont know what to do. Im 7 months pregnant, not working due to bed rest and have will be taking a maternity leave after my daughter is born. Im on medical assistance and my fiance cannot afford to shovel out 1300, he is already paying for our home, cars, and other bills. What can they do to me? Im very worried.

Answer
The order will go something like this.

Annoying collection calls...tell them to stop calling you at work...put it in writing(certified mail)

They'll sue for judgement...I wouldn't bother with showing up if the debt is legitimate

They may file for wage garnishment...Not usual for amounts this small

For amounts this small they usually sell the debt off and the process starts all over with a new collection service.
