Question
I live in FL and have been sued twice.  The credit card companies got a stipulation that I paid on four months but could no longer (back in 08) and the other got a judgement.  I am currently in the process of filing a Ch 7 bankruptcy on my own.  What do I have to file in the Hillsborough County Court in order to get released from the judgments?

Hi Sharon:

You really can't do anything until the bankruptcy is dismissed.  Then you file a motion to vacate the judgement.  The process will vary by court and jurisdiction but the court clerks and their website should be able to help.  It's really difficult for me to say what exact form or process because many are different in their procedures.

Once the judgement is vacated, you may still need to send the information to each credit bureau.  It may still show up as included in the bankruptcy but the legal hammer of a judgement should be withdrawn.
