Crime & Law Enforcement Issues & Death Penalty - Jurisdiction/procedure question

Expert: William A Saunders - 10/21/2009

Question
It's me again (last question for a while, I promise).

My P.I. heroine and her husband are on National Forest land.  They confront the bad guy, who shoots her (non-fatally) as she's trying to draw her gun.  Her husband gets her gun and shoots the bad guy (dead).  Two questions:

1. The Forest Service has jurisdiction, but would they call the local County Sheriff to collect the body and (possibly) assist with the investigation?  If not, who?

2. The bad guy is a convicted felon who isn't supposed to have a gun.  The P.I. and her husband are legal gun owners.  It's clear who shot whom (guns are different calibers, etc.).  Would the P.I. and her husband just give sworn statements and that would be the end of it?  Or would there be more investigation?  (Who would they give the statements to, and who would investigate?)

Thanks heaps!

Answer
Hello again,

The Forest Service is federal government property so crime that occurred on that land would be a federal crime and investigated by the Forest Service along with the US Park Police.

As far as the PI and his wife, they would provide a statement to the US Park Police.  The police investigators would also gather physical evidence from the scene and conduct an investigation, just as they would do if a police officer had shot someone.  Following the investigation, as long as everything matched up and the evidence supported the statements given, then the case would be closed and it would be over.
