i am currently the domestic violence coordinator for my department. i am a field training officer and i have been teaching self-defense, drugs, and search warrants and affidavits at the local academy for the past 10 years, and domestic violence for the past 3 years. i was the assitant to the federal monitor while our jail was under a consent decree, which we successfully came from under.

Question
Hi,

I have a friend who lives in a makeshift "apartment."  Actually, the building is a large house owned by an individual who resides in the house with the tenants.  Rather than apartments being rented out, the individual rooms are rented out.  There is no written contract.  Lately he has realized that there are some very illegal activities going on in the house -- specifically the production of methamphetamine.  This has come to his attention because the police are becoming involved.  He is looking for another place to live but in the meantime he is a bit worried about all of this.  We are wondering if the police come to search the house, is the room he rents out considered separate property?  I.e., do the police have the right to search the room he rents?

alex,

 legally speaking, if there are no contracts, he may have a problem.  does he have his own lock on the door?  if not, his best bet would be to cooperate with the police so that his belongings as well as his person are not taken into custody.  if he has his lock on the door and no one else has access to his room then it is considered separate property, if not, then the house is one single address.
