What is the differance between capital murder and first degree murder?

Answer
You have to understand that there are fifty states and that ALL fifty states have different laws.

Not many states have capital murder but it means murder that is punisible by the death penalty.  

First degree murder is murder with malice of forethought.

So not every first degree murder is capital murder but every capital murder is first degree murder.

You know you could have simply "googled" the two words "capital murder" and gotten a long and detailed explanation of this.

Experience

Police officer with 26 years experience. Ten years in patrol and sixteen years in the detective bureau investigating every type of crime including murder, rape, robbery, theft, fraud, missing persons, etc, etc. Also taught at the police academy in areas such as constitutional law, search and seizure, and lineups.

B.S. in Criminology from the University of Maryland.
