I'm sorry Jack,I thought the Question subject would explain the N.C.F. which in Wa. state means no charges filed,and U.P.C.S. means Unlawful Posession of a controled substance.Again, sorry for the mistake.-------------------------

Hi, A friend of mine was found with a small bag of Methamphedamine in his pocket and is going to court on the offense,my question is,prior to this arrest he had a no charges filed on a U.P.C.S about a year and a half ago,can the NCF be used against him in the court of law in this new case? being the 1st NCF was in a seperate county,in the state of Washington    thanks

    I think that I asked you this before.  What is an NCF?  Remember...there are fifty states and each have different laws, court rules, and terminology.  I can't answer your question unless you tell me what this person is charged with.  You are using terms such as UCPS and NCF which are unknown to me.

   The fact that your friend was arrested cannot be used by the prosecution in its case because no mention of a persons criminal record can be heard by the judge or jury at trial.   However under certain circumstances it could be used at sentencing if your friend was found guilty.
