Crime & Law Enforcement Issues & Death Penalty/Felony and punishment

Question
Okay thanks for your response.  However, I did find my answer via the Internet via the Miami website...not an exact answer but a range.  Appreciated your time though.  It was just a general question. It is not for me. Was having a discussion with one of my co-workers so I will not need to talk a lawyer or anything like that thank goodness.

Hi Jack,

I was wondering if someone is convicted of a Felony Charge for Cocaine/Possession what will be the fines and/or maximum jail time they might have to serve this is for Miami, FL.

Any information that you can provide will be helpful.

Thanks,
Angela
Answer -
Angela,

I'm sorry but there is no way that I could even guess at the fine or maximum jail time for any conviction.  The reason is that I am not a judge, I don't know the prior record of the defendant, I don't know the state guildlines for sentencing, the amount of drugs that the defendant was in possesion of, the seriousness of the case, and many other reasons.  I think that you should be talking to your attorney about these things because he is familiar with the laws and the likely sentences in Florida.

Trying to predict sentences and fines is simply something that I can't or will do.

Answer
Ok well I am glad that you found something but understand that there is no hard and fast answer to your question.  There  are so many variables involved that I never answer a question like that because so many are from parents or friends or people who have just been arrested and it is not fair to them to get their hopes up.

Please do NOT ask questions about potential jail sentences that you or your friends may receive in court. There is no way for me to know that. I am NOT a probation officer or a parole officer so questions about those subjects will be rejected. I am a police officer with 26 years experience. Can answer questions about crime, police procedure, investigations, criminal law, search and seizure, traffic offenses. Prefer not to answer questions on the death penalty. Please do not ask homework questions. Remember this. The law in every state is different so questions about laws that are specific to your state could be difficult to answer. I also cannot give you legal advice on what to do or not to do in court. I have worked with authors in the past and will be happy to review scenarios or plots with authors to check for believability or accuracy.
