Question
Hello - an acquaintance of my 18 year old son was at my home & stole a check out of my checkbook and was dumb enough to write it to himself and cash it.  I called the police, made a report, and went to my bank.  The written info the police officer gave me told me to contact the State's Atty's. office.  I cannot see the State's Atty. for 10 days - in the meantime, no arrest warrant will be issued until I talk to them - this is the craziest thing I've ever heard of - I am an Illinois resident. My check was stolen from my home, I know who took it, and I know who forged and cashed it.  Why can't they arrest (or at least question him) now?  Thank you.

Hello Kim,

   I really don't know why they can't arrest the suspect.  I am assuming that forgery cases are handled that way in your juristiction when the victim knows the suspect.  Every state and juristiction has its own procedure in handling bad check and forgery cases so I would suggest that you call the prosecutors office and get an explaination.

  Remember...there are fifty states with fifty different sets of laws.

Experience

Police officer with 26 years experience. Ten years in patrol and sixteen years in the detective bureau investigating every type of crime including murder, rape, robbery, theft, fraud, missing persons, etc, etc. Also taught at the police academy in areas such as constitutional law, search and seizure, and lineups.
