Crime & Law Enforcement Issues & Death Penalty/Graffiti

Question
I'm sorry to bother you over something so small but I can't find any information on this.

Yesterday some kids spray painted 'Blood' on our pickup in red paint. There has been a graffiti problem in the area for a while now even though it's a nice neighborhood. The problem has gotten worse since the police have been patrolling in their favorite place (A long, dark street that has solid fence running on both sides)

My question is IF we catch one of these kids who thinks they are in a gang either painting or walking around with a can of paint - what can we do? Is there anything we can do ourselves or is it just limited to calling the police and accepting that there is nothing that will be done?

Answer
Hello Aimee,

I would assume that vandalism is a misdemeanor in your state which probably means that the offense has to be committed in the presence of a police officer for him to make an immediate arrest.  But if the officer is supplied with information from a citizen who witnesses the crime he can apply for a warrant.  So if you, as a citizen witnesses a crime of vandalism you could cooperate with the officer and an arrest can be made.

Depending on the laws in your state you could also apply for a warrant yourself if you see a crime being commited if you know the name of the person.

But it sounds like you and your neigbbors need to meet with the police commander of your precinct and tell him about your concerns.  I am sure that he would be glad to have such a meeting.

Please do NOT ask questions about potential jail sentences that you or your friends may receive in court. There is no way for me to know that. I am NOT a probation officer or a parole officer so questions about those subjects will be rejected. I am a police officer with 26 years experience. Can answer questions about crime, police procedure, investigations, criminal law, search and seizure, traffic offenses. Prefer not to answer questions on the death penalty. Please do not ask homework questions. Remember this. The law in every state is different so questions about laws that are specific to your state could be difficult to answer. I also cannot give you legal advice on what to do or not to do in court. I have worked with authors in the past and will be happy to review scenarios or plots with authors to check for believability or accuracy.
