Back in December, my friend was DWI and crashed into a tree, was injured, and spent about a month in the hospital.  There was no other party involved in the accident, but he was taken by ambulance to the hospital so I would imagine there had to be some kind of police report.  He was never visited by a police officer while in the hospital, never cited, and is still in possession of his driver's license.

Recently, he acquired insurance for his new car, and the agent ran a report and questioned him about having the accident, but seemed rather ignorant as to the events surrounding it, and was satisfied when she learned that no one else had been involved and he received his coverage.

My question to you is this:

Is there still some chance that he will be charged with DUI even though he has never been cited?  Basically, I suppose I am just asking, how come he never had any exchange with law enforcement after such a major accident, yet
this insurance agent was made aware that it happened through a DMV report (I would assume), however vague the information she received?

Any thoughts you have on this would be greatly appreciated, and I thank you for your time.

    There is really no way that I can tell you why your "friend" has never been cited or had an exchange with law enforcement.  You would probably need to contact the police and see if they have any record of the accident and ask them these questions.
