Question
My father is with the U.S. Military. He recently came back to the states on military leave. He has his high security clearence.

During his flight back to Sacramento Ca, he had a connection in Denver Colorado. He was detained for carrying a cigarette lighter which had a small pocket knife attached. He was given a violation for possesion of a switchblade knife and a court date in Denver Colorado on 5/3/05.

I wanted to know if he can have his case tranfered to Sacrameto Ca. Also he wrote a letter requesting the judge to waive his violation. Is that possible? If not if for whatever reason  he can't make it to court, will their be an warrant issued for him in the state of Colorado or the entire U.S.?

Please give me some legal advice. My father is very concerned and would like this matter resolved asap without if effecting his security clearance.

   Sorry but this is far out of my area of expertise.  I think that you need to speak to someone who is familiar with federal law especially those that are included in the airline security industry.  I would suggest that your father retain an attorney asap.  You don't want to sit around when you are charged with a federal offense.

Experience

Police officer with 26 years experience. Ten years in patrol and sixteen years in the detective bureau investigating every type of crime including murder, rape, robbery, theft, fraud, missing persons, etc, etc. Also taught at the police academy in areas such as constitutional law, search and seizure, and lineups.

B.S. in Criminology from the University of Maryland.
