Question
I brought a car two hours from where i live.  I had to take the car back to get it fix. When it was time to  pick up the car. I ask my sister's boyfriend who live in the area the car was being fix at to pick-up the car and drive it back to where i live.  When he was driving back he got pull over by the Florida Highway Patrol.  They found a gun in the car.  They Seizure my car and stated that i brought the car for the driver to us.  I told them that was not the case, i explain why he was driving the car and i don't know the situation with the driver and the gun.  They said i refuse to answer any question and will not return the car to.  they contacted the company that the car was finance thru and now they company is going to repo the car. What can i do to get my car back.  I make all my payments and have insurance on it.  No one is answering any questions for me and i am getting the run around from the FHP.

Hi,

   It sounds like that the police are following some law that you have in your state about transporting handguns.  I am not an attorney and know nothing about the law in your state but I would think that this is will turn out to be a civil matter and you would have to get an attorney and sue the police to get your car back.  But once again the attorney would know best about the law there.

  Let me ask you this.  Was he charged with a criminal offense?

Experience

Police officer with 26 years experience. Ten years in patrol and sixteen years in the detective bureau investigating every type of crime including murder, rape, robbery, theft, fraud, missing persons, etc, etc. Also taught at the police academy in areas such as constitutional law, search and seizure, and lineups.
